Executors and administrators The firm acts for executors in obtaining probate and administering the estates of deceased persons. At this sad and stressful time we understand the necessity to deal sensitively with executors and beneficiaries. We apply for Grants of Letters of Administration in estates where the deceased person died without a will. If the deceased person owned assets overseas we can instruct lawyers in those countries to deal with the administration of those assets and to advise on any foreign taxes. Beneficiaries The firm also advises beneficiaries who are unhappy with the way in which an estate is being administered.
Deeds of variation Where there is no will or if a will is not tax-effective, it may be possible for the beneficiaries to take advantage of the opportunities presented by a deed of variation or disclaimer. The firm advises on all aspects of deeds of variation and their effect for inheritance tax and capital gains tax purposes.
Applications for English Grants in non-UK estates The firm acts regularly for many Irish solicitors and trust corporations in obtaining English Grants in Irish estates with UK assets. We advise on the UK inheritance tax aspects and on the double taxation relief available when the estate is liable to both UK inheritance tax and Irish capital acquisitions tax. We also advise on the ways in which the beneficiaries can mitigate the inheritance tax liabilities in their own estates in the future. We also advise lawyers and private individuals in other jurisdictions on all aspects of English probate practice and UK inheritance tax. Affidavits of Law We prepare Affidavits of English Law for Irish solicitors for use in applications for Irish Grants in English-domiciled estates. |
